Welcome to Chefy. By accessing or using our app, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Chefy, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our app. You must be at least 13 years old (or 16 in the European Economic Area) to use Chefy.

2. Description of Service

Chefy provides a mobile application that allows users to save, organize, and manage recipes from various sources for personal cooking use. We may also offer AI-powered cooking assistance features, meal planning tools, and related services. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

3. User Accounts

To use certain features of Chefy, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized access
• Not sharing your account with others

You may not create multiple accounts or use another person's account without permission. Each account is for individual use only.

4. Third-Party Recipe Content

Chefy allows you to save recipes from third-party websites for your personal, non-commercial use. By using this feature, you acknowledge and agree that:

• You will only save recipes you have legally and legitimately accessed
• You will not bypass paywalls, access controls, or other restrictions
• You will not use automated tools or scripts to save recipes in bulk
• Saved recipes remain the property of their original publishers and copyright holders
• You are responsible for complying with the terms of service of source websites
• You will only use saved recipes for personal cooking purposes
• You will not share, redistribute, republish, or make saved recipes publicly available

Chefy is not responsible for the accuracy, completeness, safety, or legality of third-party recipe content. We do not endorse, verify, or guarantee any recipes from external sources. Recipe content is provided "as is" for your personal reference.

5. Personal Use Only

Chefy is intended strictly for personal, non-commercial use. You agree not to:

• Use the app or saved recipes for any commercial purpose
• Sell, license, rent, or distribute saved recipes
• Create a public database, website, or collection of recipes using content from Chefy
• Use automated tools, bots, or scripts to scrape or extract data from the app
• Share your account credentials with others
• Use saved recipe content to train, develop, or operate artificial intelligence or machine learning systems
• Provide recipe data to third parties for any purpose

6. User Conduct

You agree not to:

• Use the app for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit any harmful code, viruses, or malware
• Attempt to gain unauthorized access to our systems or other users' accounts
• Harass, abuse, threaten, or harm other users
• Upload content that infringes on intellectual property rights
• Impersonate any person or entity
• Interfere with or disrupt the app or servers
• Reverse engineer, decompile, or disassemble any part of the app

7. User-Generated Content

When you submit your own content to Chefy (such as personal notes, photos, tags, reviews, or original recipes), you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, store, and distribute that content within the app and for related promotional purposes. You retain ownership of your original content.

You represent and warrant that:

• You have all necessary rights to the content you submit
• Your content does not violate any third-party rights
• Your content does not contain illegal, defamatory, or harmful material

We reserve the right to remove any user content that violates these Terms or that we find objectionable.

8. Copyright and DMCA

Chefy respects the intellectual property rights of others. Users are solely responsible for ensuring they have the right to save and use recipe content through our app.

Copyright Infringement Notifications

If you believe that content stored in Chefy infringes your copyright, please send a written notice to:

Your notice should include:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and information to locate it
• Your contact information (address, telephone number, and email)
• A statement that you have a good faith belief that use of the material is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate
• Your physical or electronic signature

Repeat Infringer Policy

We reserve the right to terminate the accounts of users who are determined to be repeat copyright infringers.

9. AI-Powered Features

Chefy may offer AI-powered cooking assistance features, including but not limited to ingredient substitutions, cooking technique explanations, and recipe-related questions and answers.

Prohibited AI Use: You agree not to:

• Use saved recipes or app content to train, fine-tune, or develop AI or machine learning models
• Extract recipe content for use in external AI systems or applications
• Use recipes in retrieval-augmented generation (RAG) systems outside of Chefy
• Export or provide recipe data to third-party AI services or tools
• Attempt to reverse engineer or replicate our AI features

10. Food Safety and Dietary Disclaimer

By using Chefy, you acknowledge and agree that:

• We are not responsible for food allergies, intolerances, adverse reactions, or any health issues resulting from recipes
• You must always read ingredient labels and verify allergen information yourself
• You are responsible for following safe food handling, storage, and cooking practices
• Nutritional information is approximate and for general reference only
• You should consult healthcare providers or registered dietitians before making significant dietary changes
• We do not provide medical, nutritional, or dietary advice
• Recipe serving sizes, cooking times, and temperatures may vary based on equipment and ingredients

You assume all risk and responsibility for food safety, ingredient selection, and dietary decisions when using recipes from Chefy.

11. Account Deletion

You have the right to delete your account and all associated data at any time.

To Delete Your Account:

Email us at support@trychefy.com with your account deletion request.

What Happens When You Delete:

• All your saved recipes, notes, photos, and personal data will be permanently deleted
• This action cannot be undone
• We will process your deletion request within 30 days
• Some data may be retained briefly for legal compliance or security purposes

12. Intellectual Property

All content, features, and functionality of Chefy, including but not limited to the app design, interface, text, graphics, logos, icons, software code, and underlying technology, are owned by Chefy and are protected by copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the app for personal purposes in accordance with these Terms.

Recipes and content saved from third-party sources remain the property of their respective copyright holders. Chefy does not claim ownership of third-party recipe content.

13. Disclaimer of Warranties

CHEFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The app will be error-free, secure, or uninterrupted
• Defects will be corrected
• The app or servers are free of viruses or harmful components
• Recipe content is accurate, complete, or safe
• AI-generated suggestions are correct or suitable for your needs

Your use of Chefy is at your sole risk. Some jurisdictions do not allow disclaimers of implied warranties, so some of the above may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHEFY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Loss of or damage to property
• Personal injury or health issues
• Food allergies or adverse reactions
• Costs of substitute services

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed $100.

15. Indemnification

You agree to indemnify, defend, and hold harmless Chefy and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the app
• Your violation of these Terms of Service
• Your violation of any third-party rights, including copyright, trademark, privacy, or other intellectual property rights
• Any content you submit, post, or save through the app
• Food safety incidents, health issues, or injuries resulting from recipes or cooking
• Your violation of any applicable laws or regulations

16. Termination

We reserve the right to suspend or terminate your account and access to Chefy at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Copyright infringement
• Extended periods of inactivity

You may terminate your account at any time by contacting us at support@trychefy.com. Upon termination, your right to use Chefy will immediately cease, and we may delete your account data.

Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

17. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you by:

• Posting the updated Terms in the app with a new "Last Updated" date
• Sending you an email notification (if you have provided an email address)
• Displaying an in-app notification

Your continued use of Chefy after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the app and delete your account.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Chefy shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and Chefy agree to waive the right to a trial by jury or to participate in a class action.

Class Action Waiver

You and Chefy agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Opt-Out

You have the right to opt out of the arbitration agreement by sending written notice to legal@trychefy.com within 30 days of first accepting these Terms. If you opt out, you and Chefy agree to resolve disputes in the state or federal courts located in Fulton County, Georgia.

19. Apple App Store Terms

If you downloaded Chefy from the Apple App Store, the following additional terms apply:

• These Terms are an agreement between you and Chefy only, not with Apple, Inc.
• Apple has no obligation to provide any maintenance or support services for Chefy
• Apple is not responsible for the app, its content, or any claims related to the app
• Apple is not responsible for addressing any claims you or third parties have relating to the app or your use of it
• In the event of any third-party claim that Chefy infringes intellectual property rights, Chefy (not Apple) will be responsible for investigation, defense, and settlement
• You represent that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you
• You must comply with all applicable third-party terms when using Chefy (e.g., wireless data service terms)
